Welcome to Catholic DeVice (the "App"). Please read these Terms of Service ("Terms") carefully. These Terms govern your access to and use of the Catholic DeVice mobile application, website, and associated services operated by Kingfisher Technologies LLC (doing business as Catholic DeVice) ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Age Requirements

You must be at least 13 years of age to use the App. If you are under 18 years of age (or the age of legal majority in your jurisdiction), you must have the consent of your parent or legal guardian to use the App, and your parent or guardian must agree to these Terms on your behalf prior to you making any Premium subscription purchases.

2. App Blocking Functionality and Emergency Disclaimer

A core feature of Catholic DeVice involves restricting or blocking your access to specific applications on your device for predetermined periods of time (the "Praywall" and the "Cloister").

YOU EXPRESSLY UNDERSTAND AND AGREE THAT BY USING THE APP BLOCKING FEATURES, YOU MAY BE UNABLE TO ACCESS CERTAIN APPLICATIONS ON YOUR DEVICE. WE SPECIFICALLY DISCLAIM ANY AND ALL LIABILITY FOR YOUR INABILITY TO ACCESS ANY APPLICATION FOR ANY REASON, INCLUDING BUT NOT LIMITED TO MEDICAL EMERGENCIES, SAFETY EMERGENCIES, COMMUNICATION CRISES, OR EXIGENT CIRCUMSTANCES.

IT IS YOUR SOLE RESPONSIBILITY TO ENSURE THAT YOU RETAIN ACCESS TO CRITICAL APPLICATIONS (SUCH AS PHONE, MESSAGING, OR MEDICAL ALERTS) AND HAVE ALTERNATIVE MEANS OF COMMUNICATION IN THE EVENT OF AN EMERGENCY. CATHOLIC DEVICE IS A DIGITAL WELLNESS TOOL AND IS NOT DESIGNED, INTENDED, OR AUTHORIZED FOR USE IN LIFE-CRITICAL OR EMERGENCY SITUATIONS. Furthermore, while we strive for effectiveness, we do not guarantee that the App will successfully block all distracting applications at all times.

3. Subscriptions, Payments, and Refunds

Catholic DeVice offers premium features through auto-renewing subscriptions.

Billing: All billing, payment processing, and subscription management are handled entirely by the third-party platform from which you downloaded the App (i.e., the Apple App Store or Google Play Store), not directly by us.

Refunds: Because we do not process your payments, all purchases are final and non-refundable to the maximum extent permitted by applicable law. We do not offer direct refunds or credits for partially used billing periods. Any requests for refunds must be directed to Apple or Google and are subject to their respective refund policies.

4. Intellectual Property

All content, features, designs, text, and graphics in the App are owned by Catholic DeVice and are protected by United States and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or reverse engineer any part of the App.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Catholic DeVice, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the app; or (b) any unauthorized access, use, or alteration of your transmissions or content.

6. Dispute Resolution, Binding Arbitration, and Class Action Waiver

Please read this section carefully. It affects your legal rights.

• Governing Law: These Terms and your use of the App shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles.
• Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Charleston, South Carolina, before a single arbitrator.
• Class Action Waiver: YOU AND CATHOLIC DEVICE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate another person's claims with your claims and may not otherwise preside over any form of a representative or class proceeding.

7. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice in the App or sending an email. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the terms.
